Officer accused of killing man in wrong apartment indicted for murder

When Guyger put her key in the apartment door, which was unlocked and slightly ajar (according to the affidavit), it opened. We appreciate the work of the Texas Rangers and the Dallas County District Attorney's Office.

Guyger was charged with manslaughter three days after 26-year-old Jean's death.

Botham Jean's mother, Allison Jean, said during a news conference that she's satisfied with the murder indictment.

"He didn't deserve it, he was seated in his own apartment".

The grand jury Friday handed down an indictment to Amber Guyger, 30, who was arrested almost three months ago and charged with manslaughter. In September, she was released on a $300,000 bond when the charge was manslaughter.

The initial decision to charge Guyger with manslaughter wasn't up to Dallas County, Dallas County District Attorney Faith Johnson said. She said she wanted to make sure the jury had everything they needed to "make the right choice".

Guyger had allegedly shot Jean, after she mistook him for an intruder upon entering his apartment after her shift was over.

Questions surrounding the case have caused global attention, with a focus on whether Guyger knew she was entering the wrong unit, and if she was justified in using deadly force as a police officer, given that Jean was in his own apartment.

Inside, the lights were off and a figure in the darkness cast a large silhouette across the room, according to Guyger. She then drew her weapon and fired twice at Jean, the affidavit said.

At a press conference, Johnson praised both the grand jury and investigators from her office for their hard work on the case.

Jean's family says in the suit that Guyger had a history of violence and used excessive force against Jean that fateful night in September, resulting in his wrongful death.

The circumstances of the shooting sparked outrage and led many to question Gugyer's account of what happened.

Robert Rogers, Guyger's attorney, was disappointed but not surprised by the indictment, given what he called an "outpouring of vindictive emotion" in a statement late Friday. She had been free on bond since her arrest.

Following her arrest, Guyger, a five-year veteran of the department, was fired, the New York Times reports.

Defense attorney and former Dallas County prosecutor Pete Schulte told the Observer earlier this week that the grand jury was more likely to indict Guyger for murder than manslaughter, if it indicted her at all, because she meant to shoot Jean. "We are focused on seeing this case through (to) a proper conviction and through an appropriate sentencing".

Jean's family has filed a lawsuit against Guyger and the city of Dallas.

Jean's killing thrust Dallas into the national conversation about the intersection of race and law enforcement, a dialogue revived by the high-profile trials of officers charged with murder in police shootings.
